وَلكِنْ إِنْ كَانَ ثَوْرًا نَطَّاحًا مِنْ قَبْلُ، وَقَدْ أُشْهِدَ عَلَى صَاحِبِهِ وَلَمْ يَضْبِطْهُ، فَقَتَلَ رَجُلاً أَوِ امْرَأَةً، فَالثَّوْرُ يُرْجَمُ وَصَاحِبُهُ أَيْضًا يُقْتَلُ.

أَمَّا إِنْ كَانَ الثَّوْرُ نَطَّاحاً مِنْ قَبْلُ، وَسَبَقَ إِنْذَارُ صَاحِبِهِ، فَلَمْ يَكْبَحْهُ، فَقَتَلَ رَجُلاً أَوِ امْرَأَةً، يُرْجَمُ الثَّوْرُ، وَيُقْتَلُ صَاحِبُهُ.
